Terms & Conditions

By accessing, registering for, or using the Service in any manner, including browsing or creating an account, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (the “Terms”), as well as any policies incorporated herein by reference, including the Privacy Policy and Cookie Policy, Data Retention Policy, and Breach Response Plan.

If you do not agree to these Terms, you must immediately discontinue use of the Service.

These Terms constitute a binding legal agreement between you and Heroes Haven LLC.

You represent and warrant that:

• You are at least eighteen (18) years of age
• You have the legal capacity to enter into a binding agreement
• You are using the Service for lawful purposes

The Service is intended for adult caregivers and individuals managing care-related information. Any use involving minors must be conducted by a parent, legal guardian, or authorized caregiver.

Heroes Haven provides a software platform designed to assist with:

• Organization of medical and care-related information
• Coordination between caregivers and support networks
• Tracking of medications, symptoms, appointments, and supplies
• Emergency preparedness documentation
• Optional AI-assisted tools
• Optional community features

The Service is a productivity and organizational tool only and does not provide clinical, diagnostic, or therapeutic functionality.

The Service is not intended to provide medical advice, diagnosis, treatment, or clinical decision-making support. All content, tools, templates, and outputs are provided for informational and organizational purposes only.

You expressly acknowledge that:

• Medical decisions must be made in consultation with qualified healthcare professionals
• The Service may contain incomplete, outdated, or inaccurate information
• Reliance on the Service for medical decisions is done entirely at your own risk

This Service must not be relied upon in emergency or life-critical situations. In the event of a medical emergency, contact 911 or your local emergency services immediately.

The Service operates as a consumer-facing personal health record (PHR) tool. Accordingly:

• Heroes Haven is not a HIPAA-covered entity
• Heroes Haven does not act as a healthcare provider or medical institution
• Heroes Haven does not enter into Business Associate Agreements (BAAs)

The Service is governed by applicable FTC consumer protection laws, including the FTC Health Breach Notification Rule.

You acknowledge and agree that:

• You are solely responsible for all data entered into the Service
• You are solely responsible for maintaining accurate, complete, and up-to-date information
• You are responsible for all caregiving, medical, and personal decisions

You further acknowledge that caregiving environments involve significant complexity, including physical, emotional, logistical, and financial burdens, and that the Service does not eliminate or assume any such responsibilities.

You agree to provide accurate and complete registration information, maintain the confidentiality of your credentials, and restrict access to authorized users only.

You are fully responsible for all activity occurring under your account and any actions taken by individuals you grant access to.

Heroes Haven shall not be liable for unauthorized access resulting from your failure to secure your account.

The Service may allow you to grant access to additional individuals, including caregivers, family members, or third-party providers. You acknowledge and agree that:

• You assume full responsibility for granting and managing access
• All users under your account act under your authority
• Heroes Haven is not responsible for misuse, errors, or actions taken by authorized users

Certain features may utilize artificial intelligence or automated processing technologies. By using such features, you acknowledge:

• Outputs may be inaccurate, incomplete, or misleading
• AI-generated content is not verified or guaranteed
• You must independently review all outputs

Heroes Haven disclaims all liability arising from reliance on AI-generated content.

Certain features require payment. You authorize recurring charges based on your selected plan. Failure to process payment may result in the suspension or termination of access.

All payments are non-refundable except as required by law.

Data handling follows our retention policy:

• Active accounts retain full access
• Cancelled accounts shall receive a thirty (30)-day export period
• Data shall be permanently deleted after sixty (60) days of non-payment
• Keep Safe tier preserves data while active
• Inactive accounts may receive notifications at 12, 15, and 18 months

Deleted data cannot be recovered under any circumstances.

You agree not to:

• Use the Service for illegal purposes
• Attempt unauthorized access
• Disrupt system operations
• Upload harmful or malicious content

We reserve the right to suspend or terminate access for violations.

If community features are introduced, you acknowledge that:

• Users may submit content to shared or public areas of the Service
• You grant Heroes Haven a non-exclusive license to display such content within the Service
• We reserve the right to moderate, remove, or restrict content at our discretion
• Heroes Haven is not responsible for user-generated content

All disputes shall be resolved through good faith negotiation, followed by binding arbitration in Nevada.

You waive jury trial rights and class action participation.
